Bem-vindo ao ETHEREAL STORE! Os termos "nós", "nos" e "nosso" referem-se ao ETHEREAL STORE. O ETHEREAL STORE opera esta loja e website, incluindo todas as informações, conteúdos, funcionalidades, ferramentas, produtos e serviços relacionados, com o objetivo de lhe proporcionar, o cliente, uma experiência de compra personalizada (os "Serviços"). Ao concordar com os presentes Termos de serviço, declara que tem pelo menos a maioridade no seu estado ou província de residência e que nos deu o seu consentimento para permitir que qualquer um dos seus dependentes menores utilize os Serviços em dispositivos que possui, compra ou gere.
Para utilizar os Serviços, incluindo o acesso ou navegação nas nossas lojas online ou a compra de qualquer
um dos produtos ou serviços que oferecemos, poderá ser-lhe solicitado que forneça determinadas informações, tais como o seu endereço de e-mail, informações de faturação, pagamento e envio. Declara e garante que todas as informações fornecidas nas nossas lojas estão corretas, atualizadas e completas e que possui todos os direitos necessários para fornecer essas informações.

SECÇÃO 3 - ENCOMENDAS
Ao fazer uma encomenda, está a fazer uma oferta de compra. O ETHEREAL STORE reserva-se o direito de aceitar ou recusar as suas encomendas por qualquer motivo, a seu exclusivo critério. As suas encomendas não serão aceites até que o ETHEREAL STORE confirme a aceitação. Temos de receber e processar o seu pagamento antes de aceitarmos a sua encomenda. Verifique cuidadosamente a sua encomenda antes de a submeter, pois o ETHEREAL STORE pode não conseguir satisfazer os pedidos de cancelamento após a aceitação de uma encomenda. Caso não aceitemos, alteremos ou cancelemos uma encomenda, tentaremos notificar através do e-mail, endereço de faturação e/ou número de telefone fornecidos no momento em que a encomenda foi feita.

SECÇÃO 4 - PREÇOS E FATURAÇÃO

Os preços apresentados nas nossas lojas online podem ser diferentes dos preços oferecidos nas lojas físicas ou em lojas online ou outras lojas operadas por terceiros. Não nos responsabilizamos por atrasos no envio e na entrega. Todos os tempos de entrega são apenas estimativas e não são garantidos. Não nos responsabilizamos por atrasos causados por transportadoras, processamento alfandegário ou eventos fora do nosso controlo. Exceto conforme expressamente previsto neste documento, nada nos presentes Termos lhe concede ou deve ser interpretado como concessão de uma licença ou outros direitos a si ao abrigo de qualquer patente, marca comercial, direitos de autor ou outra propriedade intelectual do ETHEREAL STORE, da Shopify ou de qualquer terceiro. A utilização não autorizada dos Serviços pode constituir uma violação das leis federais e estaduais de propriedade intelectual. Não teremos qualquer responsabilidade decorrente ou relacionada com a sua utilização de ferramentas opcionais de terceiros.

O ETHEREAL STORE é desenvolvido com tecnologia Shopify, o que nos permite fornecer-lhe os Serviços. Ao utilizar os Serviços, reconhece e concorda que a Shopify não é responsável por qualquer aspeto de quaisquer vendas entre si e o ETHEREAL STORE, incluindo qualquer lesão, dano ou perda resultante da compra de produtos e serviços. Por este meio, isenta expressamente a Shopify e as suas afiliadas de todas as reclamações, danos e responsabilidades decorrentes ou relacionadas com a sua compra e transação com o ETHEREAL STORE.

Concorda que o seu Feedback não violará qualquer direito de terceiros, incluindo direitos de autor, marcas comerciais, privacidade, personalidade ou outros direitos pessoais ou de propriedade. Concorda ainda que o seu feedback não conterá comentários difamatórios, ilegais, abusivos ou obscenos, nem vírus de computador ou outros malwares que possam afetar de alguma forma o funcionamento dos Serviços ou de qualquer website relacionado. Não pode utilizar um endereço de e-mail falso para enviar o feedback, fingir ser outra pessoa ou enganar-nos, ou a terceiros, quanto à origem de qualquer feedback. É o único responsável por qualquer feedback que forneça e pela sua precisão. Não nos responsabilizamos por qualquer feedback publicado por si ou por terceiros.

SECÇÃO 12 - ERROS, IMPRECISÕES E OMISSÕES
Ocasionalmente poderá existir informação nos Serviços que contenha erros tipográficos, imprecisões ou omissões que possam estar relacionadas com a descrição do produto, preços, promoções, ofertas, taxa de envio do produto, prazo de envio e disponibilidade. Reservamo-nos o direito de corrigir quaisquer erros, imprecisões ou omissões, e de alterar ou atualizar informações ou cancelar encomendas se alguma informação estiver incorreta, a qualquer momento, sem aviso prévio (incluindo após ter submetido a sua encomenda).

SECÇÃO 13 - UTILIZAÇÕES PROIBIDAS
Poderá aceder e utilizar os Serviços apenas para finalidades lícitas. Não poderá aceder ou utilizar os Serviços, direta ou indiretamente: (a) para qualquer finalidade ilegal ou maliciosa; (b) para violar quaisquer regulamentos, regras, leis ou decretos locais, estaduais, provinciais, federais ou internacionais; (c) para infringir ou violar os nossos direitos de propriedade intelectual ou os direitos de propriedade intelectual de terceiros; (d) para assediar, abusar, insultar, prejudicar, difamar, caluniar, depreciar, intimidar ou prejudicar qualquer um dos nossos funcionários ou qualquer outra pessoa; (e) para transmitir informações falsas ou enganosas; (f) para enviar, receber, carregar, transferir, utilizar ou reutilizar conscientemente qualquer material que não esteja em conformidade com os presentes Termos; (g) para transmitir ou obter o envio de qualquer material publicitário ou promocional, incluindo qualquer "lixo eletrónico", "carta em cadeia", "spam " ou qualquer outro pedido semelhante; (h) fazer-se passar por ou tentar fazer-se passar por qualquer outra pessoa ou entidade; ou (i) envolver-se em qualquer outra conduta que restrinja ou iniba a utilização ou aproveitamento dos Serviços por qualquer pessoa, ou que, conforme determinado por nós, possa prejudicar o ETHEREAL STORE, a Shopify ou os utilizadores dos Serviços, ou expô-los a responsabilidades.
Além disso, concorda em não: (a) carregar ou transmitir vírus ou qualquer outro tipo de código malicioso que possa ser utilizado de qualquer forma que afete a funcionalidade ou o funcionamento dos Serviços; (b) reproduzir, duplicar, copiar, extrair, vender, revender ou explorar qualquer parte dos Serviços; (c) recolher ou rastrear informações pessoais de terceiros; (d) enviar spam, praticar phishing, pharming ou pretexting nos Serviços; (e) utilizar qualquer robot, spider, ferramenta de scraping, ferramenta de recolha e extração de dados, dispositivo ou processo automático, ferramenta de inteligência artificial (como a IA agêntica) ou meios automatizados ou manuais para aceder aos Serviços; ou (f) interferir, contornar ou iludir as funcionalidades de segurança ou autorização, exclusão de robots ou outras medidas que empregamos para restringir o acesso aos Serviços. Reservamo-nos o direito de suspender, desativar ou rescindir a sua conta a qualquer momento, sem aviso prévio, caso determinemos que violou qualquer parte dos presentes Termos.

SECÇÃO 14 - AGENTES
14.1 Esta secção ("Termos do Agente") aplica-se se utilizar, permitir, ativar ou provocar a implementação de um Agente para aceder, utilizar ou interagir com quaisquer Serviços. "Agente" significa qualquer software ou serviço que execute ações autónomas ou semiautónomas em nome de, ou sob as instruções de, qualquer pessoa ou entidade e que possa ser executado em nome de, ou utilizando o dispositivo de uma pessoa, sem supervisão direta.
14.2 Nenhum Agente poderá aceder, utilizar ou interagir com os Serviços, a menos que, em todos os momentos, se identifique e opere em estrita conformidade com os requisitos da secção 14.4 abaixo. Além disso, nenhum Agente poderá aceder, utilizar ou interagir com os Serviços se tivermos solicitado que o Agente se abstenha de aceder, utilizar ou interagir com qualquer serviço.
14.3 Podemos limitar, inclusive por medidas técnicas, se e como qualquer Agente acede, utiliza e interage com os Serviços.
14.4 Os Agentes devem: (i) em todos os pedidos HTTP/HTTPS, identificar que o pedido é de um Agente e divulgar o nome do Agente incluindo o seguinte na cadeia de agentes de utilizador do pedido: "Agente/[nome do agente]"; (ii) não ocultar ou disfarçar que qualquer acesso, utilização ou interação é de um Agente, como (a) imitando o comportamento e os padrões de interação humanos ou (b) preenchendo ou contornando o CAPTCHA ou as medidas destinadas a distinguir a utilização do computador da utilização humana; (iii) responder com sinceridade a qualquer questão ou prompt que procure determinar se as interações são provenientes de um ser humano ou de um computador; (iv) não contornar ou evitar qualquer medida destinada a bloquear, limitar, modificar ou controlar se e como os Agentes acedem, utilizam ou interagem com os Serviços.

SECÇÃO 15 - RESCISÃO
Podemos rescindir o presente contrato ou o seu acesso aos Serviços (ou qualquer parte deles) a nosso exclusivo critério, a qualquer momento, sem aviso prévio, e permanecerá responsável por todos os valores devidos até a data da rescisão, inclusive.
As seguintes secções continuarão a aplicar-se após qualquer rescisão: Propriedade intelectual, Feedback, Rescisão, Exclusão de responsabilidade de garantias, Limitação de responsabilidade, Indemnização, Divisibilidade, Renúncia; Totalidade do contrato, Cessão, Legislação aplicável, Política de Privacidade e quaisquer outras disposições que pela sua natureza devam sobreviver à rescisão.

SECÇÃO 16 - EXCLUSÃO DE RESPONSABILIDADE DE GARANTIAS
As informações apresentadas nos Serviços ou através dos mesmos são disponibilizadas exclusivamente para finalidades de informação geral. Não garantimos a exatidão, integridade ou utilidade desta informação. Qualquer decisão tomada com base nesta informação é da sua inteira responsabilidade. Eximimo-nos de toda e qualquer responsabilidade decorrente da confiança depositada nesses materiais por si ou por qualquer outro visitante dos Serviços, ou por qualquer pessoa que possa ser informada sobre qualquer parte do seu conteúdo.
EXCETO CONFORME EXPRESSAMENTE DECLARADO PELO [COMERCIANTE], OS SERVIÇOS E TODOS OS PRODUTOS OFERECIDOS ATRAVÉS DOS SERVIÇOS SÃO FORNECIDOS 'TAL COMO ESTÃO' E 'CONFORME DISPONÍVEIS' PARA SUA UTILIZAÇÃO, SEM QUALQUER DECLARAÇÃO, GARANTIA OU CONDIÇÃO DE QUALQUER TIPO, SEJA EXPRESSA OU IMPLÍCITA, INCLUINDO TODAS AS GARANTIAS OU CONDIÇÕES IMPLÍCITAS DE COMERCIALIZAÇÃO, QUALIDADE COMERCIAL, ADEQUAÇÃO A UM DETERMINADO FIM, DURABILIDADE, TITULARIDADE E NÃO VIOLAÇÃO. NÃO GARANTIMOS, DECLARAMOS OU ASSEGURAMOS QUE A SUA UTILIZAÇÃO DOS SERVIÇOS SERÁ ININTERRUPTA, OPORTUNA, SEGURA OU ISENTA DE ERROS. ALGUMAS JURISDIÇÕES LIMITAM OU NÃO PERMITEM A EXCLUSÃO DE RESPONSABILIDADE DE GARANTIAS IMPLÍCITAS OU OUTRAS, PORTANTO, A ISENÇÃO DE RESPONSABILIDADE ACIMA PODE NÃO SE APLICAR AO SEU CASO.

SECÇÃO 17 - LIMITAÇÃO DE RESPONSABILIDADE
NA MEDIDA DO PERMITIDO POR LEI, EM NENHUMA CIRCUNSTÂNCIA O [COMERCIANTE], OS NOSSOS PARCEIROS, DIRETORES, FUNCIONÁRIOS, AFILIADOS, AGENTES, CONTRATADOS, PRESTADORES DE SERVIÇOS OU LICENCIADORES, OU OS DA SHOPIFY E DAS SUAS AFILIADAS, SERÃO RESPONSÁVEIS POR QUAISQUER LESÕES, PERDAS, RECLAMAÇÕES OU QUAISQUER DANOS DIRETOS, INDIRETOS, INCIDENTAIS, PUNITIVOS, ESPECIAIS OU CONSEQUENCIAIS DE QUALQUER TIPO, INCLUINDO, SEM LIMITAÇÃO, LUCROS CESSANTES, PERDA DE RECEITAS, PERDA DE POUPANÇAS, PERDA DE DADOS, CUSTOS DE SUBSTITUIÇÃO OU QUAISQUER DANOS SEMELHANTES, SEJA COM BASE EM CONTRATO, DELITO (INCLUINDO NEGLIGÊNCIA), RESPONSABILIDADE OBJETIVA OU DE OUTRA FORMA, DECORRENTES DA SUA UTILIZAÇÃO DE QUALQUER UM DOS SERVIÇOS OU DE QUAISQUER PRODUTOS ADQUIRIDOS UTILIZANDO OS SERVIÇOS, OU POR QUALQUER OUTRA RECLAMAÇÃO RELACIONADA DE QUALQUER FORMA COM A SUA UTILIZAÇÃO DOS SERVIÇOS OU DE QUALQUER PRODUTO, INCLUINDO, ENTRE OUTROS, QUAISQUER ERROS OU OMISSÕES EM QUALQUER CONTEÚDO, OU QUAISQUER PERDAS OU DANOS DE QUALQUER TIPO INCORRIDOS COMO RESULTADO DA UTILIZAÇÃO DOS SERVIÇOS OU DE QUALQUER CONTEÚDO (OU PRODUTO) PUBLICADO, TRANSMITIDO OU DE OUTRA FORMA DISPONIBILIZADO ATRAVÉS DOS SERVIÇOS, MESMO QUE AVISADO DA SUA POSSIBILIDADE.

SECÇÃO 18 - INDEMNIZAÇÃO
Concorda em indemnizar, defender e isentar o ETHEREAL STORE, a Shopify e as nossas afiliadas, parceiros, diretores, funcionários, agentes, contratados, licenciadores e fornecedores de serviços de quaisquer perdas, danos, responsabilidades ou reclamações, incluindo honorários razoáveis de advogados, pagáveis a terceiros devido a ou decorrentes (1) da sua violação dos presentes Termos de serviço ou dos documentos que incorporam por referência, (2) da sua violação de qualquer lei ou dos direitos de terceiros, ou (3) do seu acesso e utilização dos Serviços.
